AI Assistant Terms of Use

Purpose of the AI Assistant

The Advize AI Assistant is an automated informational feature designed to help users understand:

  • Permit structure
  • Regulatory document organization
  • How public data is typically reported

AI Limitations (Critical)

The AI Assistant:

  • Generates responses probabilistically
  • May be incomplete, outdated, or incorrect
  • Is not authoritative

Outputs must not be relied upon for regulatory, legal, or compliance decisions.

No Agency or Professional Authority

The AI Assistant:

  • Does not act on behalf of any regulatory agency
  • Does not reflect agency interpretations or positions
  • Does not create a professional-client relationship

Prohibited Use

The AI Assistant will not provide:

  • Compliance determinations
  • Legal advice
  • Enforcement or litigation predictions
  • Instructions to avoid regulatory oversight

Logging & Monitoring

Interactions may be logged for:

  • Security
  • Quality assurance
  • Platform improvement

Refusal & Restriction

Advize reserves the right to refuse, restrict, or terminate AI Assistant access at its sole discretion for any reason, including suspected misuse or attempts to circumvent usage policies.

Data Use Policy

Advize uses:

  • Public permit documents
  • User-uploaded files
  • Public environmental data (e.g., weather data)

Advize does not control or verify third-party data accuracy.

Data Processing

Data is processed to:

  • Organize records

Data Accuracy Disclaimer

Advize does not warrant:

  • Accuracy
  • Completeness
  • Timeliness
  • Correctness of source data

Public records may contain errors or omissions.

Data Refresh & Timing

Data refresh frequency depends on source availability and may not reflect the most current agency updates.

Data Ownership

  • Users retain ownership of uploaded documents
  • Advize owns proprietary methodologies, scores, and outputs
  • Aggregated, anonymized insights may be used internally

Third-Party Access

Customer-specific data is not shared without authorization, except as required by law.

General Terms of Service

1. Acceptance of Terms

By accessing or using Advize.ai (the "Services"), operated by Advize LLC ("we," "our," or "us"), you ("you" or "User") agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

We reserve the right to modify these Terms at any time. Your continued use of the Services following any changes constitutes acceptance of the modified Terms.

2. Description of Services

Advize.ai is an artificial intelligence software-as-a-service (SaaS) platform that analyzes publicly available environmental compliance data to generate informational reports, identify potential data gaps, and provide organizational tools for regulatory document management.

The Services aggregate and analyze data from public sources including, but not limited to, EPA ECHO, state environmental agency databases, and other publicly accessible regulatory portals.

3. No Legal Advice; No Professional Relationship

THE SERVICES DO NOT PROVIDE LEGAL ADVICE. All information, content, reports, and analyses provided through the Services are for general informational and educational purposes only.

WE ARE NOT ATTORNEYS. Advize.ai and Advize LLC are technology companies, not law firms. No employees, contractors, or representatives of Advize are acting as your attorney or providing legal counsel.

NO ATTORNEY-CLIENT RELATIONSHIP. Your use of the Services, communication with us, submission of information, or receipt of any reports or assessments does not create an attorney-client relationship, a fiduciary relationship, or any other professional relationship.

CONSULT A QUALIFIED ATTORNEY. If you require legal advice regarding environmental compliance, regulatory matters, or any other legal issue, you must consult with a licensed attorney qualified to practice in your jurisdiction.

NO RELIANCE FOR LEGAL DECISIONS. You should not rely solely on information provided by the Services to make legal decisions, respond to legal threats, or take (or refrain from taking) any action with legal consequences.

4. No Guarantees; Assumption of Risk

NO GUARANTEE OF OUTCOMES. The Services are designed to help organize and understand regulatory information. However, we make no representations, warranties, or guarantees that use of the Services will prevent enforcement actions, fines, penalties, or any other adverse legal or regulatory outcomes.

RISK CANNOT BE ELIMINATED. Every facility subject to environmental permits faces some level of regulatory risk. While the Services may help you organize information, it cannot eliminate risk entirely.

ASSUMPTION OF RISK. You acknowledge and accept that compliance with environmental regulations is your responsibility, and you assume all risks associated with your compliance status, regulatory interactions, and any legal proceedings regardless of your use of the Services.

5. Accuracy of Information

While we strive to provide accurate and up-to-date information, the Services rely on data from third-party public sources that may contain errors, omissions, or delays. We do not guarantee the accuracy, completeness, timeliness, or reliability of any information provided through the Services.

AI-generated analyses are probabilistic in nature and may not reflect all relevant factors. The Services should be used as one of many tools in your information management strategy, not as a sole source of truth.

6. User Responsibilities

By using the Services, you agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of your account credentials
  • Use the Services only for lawful purposes
  • Not attempt to reverse engineer, decompile, or derive source code from the Services
  • Not use the Services to harm, harass, or defraud others
  • Comply with all applicable laws and regulations
  • Consult with qualified professionals (including attorneys) for advice specific to your situation
  • Validate all AI-generated outputs before relying on them

7. Intellectual Property

The Services, including its software, algorithms, user interface, documentation, and all associated intellectual property, is owned by Advize LLC and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ADVIZE.AI, ADVIZE LLC, OR THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business
  • Loss of data or information
  • Regulatory fines, penalties, or sanctions
  • Legal fees, court costs, or settlement amounts
  • Damages arising from enforcement actions or other legal proceedings
  • Any other losses arising from or related to your use of the Services

THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNTS YOU HAVE PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT THE RESULTS OBTAINED FROM USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE.

10. Indemnification

You agree to indemnify, defend, and hold harmless Advize.ai, Advize LLC, and their affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your violation of any third-party rights
  • Any enforcement action or legal proceeding against you or your facility
  • Any claim that your use of the Services caused damage to a third party

11. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Washington State, and the arbitrator's decision shall be final and binding.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Advize.ai or Advize LLC.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

13. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Advize.ai regarding the Services and supersede all prior agreements and understandings.

YOU FURTHER ACKNOWLEDGE THAT ADVIZE.AI IS NOT A LAW FIRM, DOES NOT PROVIDE LEGAL ADVICE, AND THAT USE OF THE SERVICES DOES NOT GUARANTEE ANY PARTICULAR OUTCOME REGARDING COMPLIANCE, LITIGATION, OR REGULATORY MATTERS.
